Construction Permit

Construction permit is a legal document issued by a competent state agency to an investor for new construction, repair, renovation or relocation of works. Except for the prioritized cases, according to the regulations, before starting the construction of the work, the investor must obtain a construction permit.

Document of application for a building permit

The investor directly submits 01 set of documents to the construction permit-issuing agency. The Document of application for a construction permit includes the following papers:

1. An application form for a construction permit (made according to the requirements of each case and each type of work).

2. A notarized copy of one of the papers on land use rights as prescribed by the land law; documents of ownership of works, houses, in case of repair and renovation; The letter of authory, in the case of being authorized by the work owner to carry out repairs and renovations; decisions on permitting construction investment of competent authorities for urban underground works; decide to approve the environmental impact assessment report or commit to environmental protection in accordance with the provisions of the law on environmental protection.

3. Two sets of design drawings are appraised and approved by an organization or individual that is qualified and has the capacity to perform. Each set includes:

  • Drawing of the site and location of the work on the land lot, the boundary plan of the land lot, the plan drawing, the connection diagram with the technical infrastructure outside the fence of the work.
  • Drawings of the main plans, elevations and sections of the work;
  • Drawings of foundation plan, footing section, structural drawings of main bearing capacity (foundation, frame, wall, load-bearing roof);
  • The approved fire prevention and fighting system drawings for works on the list of required fire and explosion prevention and fighting plans according to the provisions of the law on fire prevention and fighting;
  • In case of repair or renovation, there must be drawings of the location and items to be renovated, if it affects the structure of the work, there must be a report on the results of survey and assessment of the quality of the old structure related to the renovation items and reinforcement measures to determine eligibility for repair and renovation, together with photos of the current status of the work applying for a renovation permit and adjacent works.

4. In the case of installation of other equipment or structures into the built work, but not under the ownership of the investor, a notarized copy of the contract with the owner of the work is required.

5. The project approval decision shall be enclosed with the investment approval document from the competent authority, the written opinion on the basic design (if any) from the state management agency as prescribed by law.

Competence to grant, adjust, extend and revoke construction permits

  1. Provincial-level People's Committees may authorize the Department of Construction to issue construction permits for construction works of special grade, grade I, grade II; religious works; historical and cultural monuments; monumental works, monumental paintings on the administrative boundaries of the province under the management of the province; works on main routes and streets in urban areas; works under projects with foreign direct investment capital; works under the project and other works prescribed by the People's Committee of the province.
  2. District-level People's Committees may issue construction permits for remaining works and separate houses in urban areas within the administrative boundaries of that district, except for the subjects specified in Clause 01, Article 14 of Decree No. 64/2012/ND-CP on issuance of construction permits.
  3. Commune People's Committees are allowed to issue construction permits for separate houses in residential areas in rural areas that have approved and approved construction plannings within administrative boundaries managed by the commune.
  4. For a work that is granted a construction permit by an agency, that agency has the authority to adjust, extend, re-issue and revoke the construction permit granted by its agency.
  5. Provincial-level People's Committees decide to revoke construction permits issued by subordinates in contravention of regulations.
