PROCEDURES FOR INVESTMENT LICENSE IN VIETNAM

PROCESS AND TIME OF INVESTMENT LICENSE

INVESTMENT LICENSE

Currently, the issuance of investment licenses has become much more convenient and easier. With a simplified process, the one-stop shop makes it easier for businesses and individuals who want to apply for an investment license to carry out these processes. Here are the areas you need to apply for an investment license to be able to do business in Vietnam:

1. Projects outside industrial parks, export processing zones, high-tech zones and economic zones:

1.1. Projects regardless of domestic or foreign capital and investment scale:

  • Construction and business of airports, air transport;
  • Construction and business of national seaports;
  • Exploration, extraction and processing of oil and gas; mineral exploration and exploitation;
  • Radio and television industry;
  • Casino business;
  • Manufacture of cigarettes;
  • Establishing university-level training institutions;
  • To establish industrial parks, export processing zones, high-tech zones and economic zones.

 

1.2. Projects regardless of capital source and with an investment scale of VND 1,500 billion or more:

  • Trading in electricity, mineral processing, metallurgy;
  • Construction of railway, road and inland waterway infrastructure;
  • Producing and trading in wine and beer.

 

1.3. Foreign-invested projects:

  • Shipping business;
  • Establishing networks and providing postal, delivery, telecommunications and internet services; establish broadcast transmission network;
  • Printing, press release; publish;
  • Establish an independent scientific research base.

 

If the project in the above sectors belongs to the planning approved by the Prime Minister and meets the conditions prescribed by law, International conventions to which Vietnam is a member do not need to be submitted to the Prime Minister but will be granted investment licenses by competent authorities.

If the above projects do not belong to the planning approved by the Prime Minister or do not satisfy the conditions of international conventions on market opening, the investment certificate-issuing agency will stand to collect opinions from relevant ministries, It will then be submitted to the Prime Minister for consideration, If the Prime Minister approves the project, the competent authority will issue an investment license, If not approved, a letter explaining the reason will be sent to the enterprise or individual submitting the project.

The last case is the development of industrial park infrastructure, construction of export processing zones and high-tech zones in which a management board has not yet been established, then the issuance of investment certificates will be decided by the provincial-level People's Committees.

 

DOCUMENTATION FOR INVESTMENT LICENSE

Your application for an investment license should be prepared as follows:

  1. Application for a license for the project
  2. Identity card notarized copy
  3. The document specifying the project's content
  4. Documents verifying your capital or financial ability
  5. Written proposal for land use, migration and resettlement plan if you use large land bank.
  6. Assessment of environmental impact and measures to protect the environment
  7. A written explanation of the technology used, if any
  8. Evaluate the economic viability of this project.

* Place of application for investment license: Department of Planning and Investment where the project is implemented.

The actual application process for an investment license is quite complicated. Currently, most of the projects applying for a license are through an investment license application service unit Because if you lack experience in preparing project documents when submitting, you will not be able to convince the relevant agencies and easily be rejected. Once a project has been rejected, it is very difficult to supplement and resubmit it because rejected projects will usually be carefully considered by Ministries and Sectors for your project implementation capacity.
